Terms of Sales

  • 1. Scope

    The general conditions of sale (hereinafter " GTC ") apply to all legal acts concluded on the online shops www.carnetsdespossibles.ch and www.carnetsdespossibles.com, www.carnetsdespossibles.fr, www.carnetsdespossibles.be (hereinafter individually referred to as “ online store ”). The online stores are managed by the company Carnets des Possibles (hereinafter “ Carnets des Possibles ”).

    Carnets des Possibles reserves the right to modify these T&Cs at any time. The version of the GTC in force at the time of the order is decisive and cannot be unilaterally modified for this order. Customer conditions that conflict with or deviate from these T&Cs are not recognised.

    Deliveries are only made to addresses in Switzerland, Europe or any country in the list available at the time of the order.

    The offer is valid as long as the product can be found in the online store using the search function and/or while stocks last.

    Carnets des Possibles reserves the right to refuse orders exceeding the usual quantities for a household.

  • 2. Information

    2.1 Product and price

    Product images in advertising, flyers, online store, etc. are for illustration and are non-binding.

    All sales prices published in the online store are final prices, which include all taxes (including VAT), any anticipated recycling taxes (TAR), packaging costs, as well as delivery costs for the requested delivery period and any other taxes or fees. Carnets des Possibles reserves the right to modify the prices of the products and services offered at any time. The price indicated in the online shop at the time of the order is decisive for the conclusion of the sales contract.

    If the customer orders from a trader domiciled abroad who is not registered in the Swiss VAT register, the customer, considered as importer of the products delivered by the trader, is liable for import VAT and customs duties. possible.

    2.2 Availability and delivery time

    Carnets des Possibles attaches great importance to displaying the most up-to-date and accurate availability and delivery times in the online store. Due to production or delivery problems, however, delivery delays may occur at Carnets des Possibles. This is why all information relating to availability and delivery time is given for information only and may be modified at any time.

  • 3. Conclusion of the Contract

    The products and prices published in the online store are considered offers. However, these offers are always subject to the resolutory condition of an impossibility of delivery or an erroneous price indication.

    For the products and services of Carnets des Possibles, the contract is concluded with Carnets des Possibles as soon as the customer places their order in the online store (hereinafter “ contract ”).

    Carnets des Possibles acts in this case only as an intermediary, but does not itself become a contracting party. For the products and services offered by a supplier having its registered office abroad and which is not registered in the Swiss VAT register, the sales contract is concluded on the basis of the price indicated in euros or in Swiss francs in the Online Store.

    In the event of an online order, receipt of the order is confirmed to the customer by means of an automatically generated order confirmation by e-mail. The receipt of the automatically generated order confirmation does not contain confirmation that the product can actually be delivered. It only informs customers that the online store has received their order and that the contract has therefore been concluded with Carnets des Possibles or the merchant, provided that the latter can be delivered and that the price indicated is correct.

  • 4. Delivery Times

    In the event of late delivery by Carnets des Possibles or its partner, the customer is entitled (except for special orders) to withdraw from the contract from the 60th calendar day following the delivery time initially announced. In this case, Carnets des Possibles reimburses the customers for the amounts already paid. There is no possibility of claiming against Carnets des Possibles or the partner.

  • 5. Delivery

    The products that the customer buys can only be sent to him and cannot be picked up at a branch.

    The delivery address must be in Switzerland or one of the countries specified in the list.

    If the customer does not receive the products ordered on the delivery date, Carnets des Possibles may terminate the contract (cancellation) and invoice the customer for the delivery costs incurred and any loss of value.

    Delivery and Liability:

    Carnets des Possibles' products are shipped to the address specified during the order. Once the ordered items are handed over to the carrier, Carnets des Possibles disclaims any responsibility for potential issues arising during delivery, such as package loss, damage, or an incorrect delivery address.

    Error in Coordinates:

    In the event of an error in the coordinates provided by the customer, Carnets des Possibles cannot be held responsible for potential delays or delivery impossibility. It is the customer's responsibility to ensure that the delivery information provided during the order is accurate and complete.

    Delivery Impossibility due to Customer Error:

    If delivery impossibility occurs due to an error in the address provided by the customer, no refund will be issued by Carnets des Possibles. It is the customer's responsibility to ensure the accuracy of the information provided at the time of the order. Carnets des Possibles reserves the right to charge additional fees for any new delivery attempt due to a buyer's error.

    Exclusion of Refund:

    In the specific case of delivery impossibility related to an error in the address provided by the customer, no refund will be granted. Carnets des Possibles disclaims any responsibility for consequences resulting from incorrect information provided by the customer.

  • 6. Customer Control Duty

    It is also the customer's responsibility to check the products delivered immediately after receipt as to their accuracy, completeness and functionality.

    If the delivery was made by a transport company, any damage to the delivery must be specified on the delivery note.

    Any errors or damages must be reported to Carnets des Possibles (even if it is a product or service from a partner merchant) immediately after their discovery or at the latest within 2 calendar days following the receipt of products. Customers are aware that such damage must be reported via the contact form or by e-mail to contact@carnetsdespossibles.com. Customers are not authorized to use a damaged product. She must keep it in its original packaging and follow the instructions for the return process indicated under the "Returns" section of the FAQ.

  • 7. Liability

    7.1 Liability

    Liability is subject to the provisions defined by law. However, Carnets des Possibles or the merchant are never liable for (i) slight negligence, (ii) direct, indirect and consequential damages, loss of earnings, (iii) unrealized savings, as well as ( iv) damages resulting from a delay in delivery, and (v) any actions or omissions of Carnets des Possibles' auxiliaries or a trader, whether within the framework of a contract or outside of any contract.

    In addition, Carnets des Possibles or the merchant disclaims all liability for the following causes:

    • improper, contractual or unlawful storage, positioning or use of the product;
    • use of incompatible accessories or spare parts.

    7.2. Limitation of Liability

    Carnets des Possibles disclaims all liability for loss or damage of any kind - whether directly, indirectly or consequentially - resulting from the use of or access to the Carnets des Possibles websites or links managers to third-party websites. Carnets des Possibles does not guarantee the faultless operation of all parts of its site. In addition, Carnets des Possibles rejects any responsibility for the manipulation of an Internet user's computer system by unauthorized third parties.

  • 8. Payment

    8.1 Methods of payment

    Carnets des Possibles sends payment requests for products purchased from Carnets des Possibles online stores directly to customers. With the conclusion of the contract, the trader assigns the entire claim, resulting from the purchase contract between him and the customer, to Carnets des Possibles (assignment). The clientele acknowledges this assignment and is required to send all payments only to Carnets des Possibles.

    Customers can use the payment methods offered in the online store under “Payment methods”.

    The fees in force are indicated in the “Payment methods” section and are detailed in the order process.

    In the event of payment by credit card or other means of instant payment, the debit takes place at the time of the order.

    8.2 Retention of title

    The products ordered remain the property of Carnets des Possibles or the merchant until full payment has been made. Carnets des Possibles or the trader is entitled to make a corresponding entry in the register of retention of title. Prior to the transfer of ownership, no pledge, assignment as security, transformation or modification is authorized without the express consent of Carnets des Possibles.

  • 9. Modification or Cancellation of the Order

    Orders oblige customers to accept the products and services. Carnets des Possibles may, at its sole discretion, accept subsequent modifications or cancellations of orders and charge compensation of 20% of the amount of the canceled order, but at least CHF 60.–, as well as any loss of value.   • 10. Returns of Goods Delivered Without Defect

    Customers must contact Carnets des Possibles themselves and, after confirmation of the return by Carnets des Possibles, return the goods to the address indicated, at their own expense. Products must be sent with all accessories in the original packaging and adequately packaged. Damaged products are not taken back and are invoiced to the customer in full.

    If customers use their right of return in accordance with the aforementioned return conditions, Carnets des Possibles will reimburse them the full purchase price, with the exception of the costs for restocking and administration in the amount of CHF 60.

  • 11. Other Provisions

    11.1 Partial invalidity

    If certain provisions of these GCS should prove to be null or void, the validity of the other provisions of the contract is in no way modified.

    11.2 Jurisdiction and applicable law

    All legal relations between Carnets des Possibles or a merchant and customers are subject to Swiss substantive law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

    Only the following courts are applicable:

    For all disputes arising from sales contracts with Carnets des Possibles as contracting party:
    for legal actions brought by consumers, the forum is Geneva or that of the customer's domicile. In all other cases, the exclusive forum is Geneva.

    For all disputes arising from sales contracts with a trader as contracting party:
    for legal actions brought by consumers, the place of jurisdiction is the registered office of the trader. In all other cases, the exclusive forum is the registered office of the trader.

    For all disputes arising from sales contracts with a trader as contracting party:
    for legal actions brought by consumers, the place of jurisdiction is the registered office of the merchant or that of the domicile of the customer e.

    11.3 Copyrights

    All rights, in particular intellectual property, of these GCS are reserved to Carnets des Possibles.

    Any reproduction, distribution or other use is prohibited and is only authorized with the express written consent of Carnets des Possibles. In the event of non-compliance with this directive, Carnets des Possibles reserves the right to initiate legal proceedings.
